Seeking approval for recommended settlement of substantial back dated service charge claim against the City Council.

1.         That this report be exempt from disclosure by virtue of the Local Government Act 1972, Schedule 12A, Part 1, paragraph 1, in that it contains information relating to an individual and paragraph 3 in that it refers to the financial or business affairs of others (including the authority holding that information).

2.         That the Cabinet Member for Finance and Corporate Services and the Cabinet Member for Housing, Regeneration, Business and Economic Regeneration approved the recommended settlement (Option l) in the report in order to both reduce the claim against the Council to the lowest negotiable figure and control the long term liability.

Reasons for Decision 

The proposed settlement will result in a considerable saving to the Council in comparison to the original claim, reduce the liability of the Council for the remainder of the term of the underlease to contribute to the running costs and rates by half as well as offering the opportunity to earn future income from the retained spaces which can be offset against onward service charge liability.
