Purpose:

To seek approval of extra funding to secure Vacant possession and enable the development and early demolition of Dudley House.

Decision:

1.            That this report be exempt from disclosure by virtue of the Local Government Act 1972 Schedule 12A, Part 1, paragraph 3 (as amended), in that it contains information relating to the financial or business affairs of any particular person (including the authority holding that information) and paragraph 5 - Information in respect of which a claim to legal professional privilege could be maintained in legal proceedings.

2.            That the Cabinet Member for Finance and Corporate Services authorised a virement from within the capital programme for the amount as set out in the report to increase the net budget for the project.

3.            That the Cabinet Member for Finance and Corporate Services approved expenditure of up to the amount as set out in the report against the capital programme budget and noted that funds will cover the entire Design and Build (D&B) development of the project and will be part funded by Affordable Housing Fund and EFA funding and that If costs exceed this value then an additional Cabinet Member report would be required for approval.

 

4.            That the Cabinet Member for Finance and Corporate Services agreed to delegate authority to the Head of Development working collaboratively with the Director of Legal Services, to negotiate and enter into the two separate D&B contracts, to firstly carry out the advance works (piling, ground works, frame and drainage packages) and secondly carry out the remaining works under separate JCT Design and Build Contracts.

 

5.            That the Cabinet Member for Children and Young People noted the decisions made by the Cabinet Member for Finance and Corporate Services.

 

Reasons for decision

 

1.            Officers  are requesting this decision in order to sign an advanced works contract to secure tendered packages at returned rates and save estimated programme slippage of around 4 months enabling the build programme of the school to be met in line with the Education Funding Authority’s need to have the school ready for occupation by September 2018.

 

2.            A decision on an increase in budget due to items highlighted in this report is also required in order for the scheme to proceed.
