Purpose:

Budget approval sought.

Decision:

1.            That this report be exempt from disclosure by virtue of the Local Government Act 1972, Schedule 12A Part 1, paragraph 3 (as amended), in that it contains information relating to the financial or business affairs of any particular person (including the authority holding that information).

2.            That the Cabinet Member for Housing, Regeneration, Business and Economic Development, the Cabinet Member for Adults and Public Health and the Cabinet Member for Finance and Corporate Services noted the content of the Outline Business Case for the project at Shirland Road.

3.            That the Cabinet Member for Housing, Regeneration, Business and Economic Development agreed that a sum of the Affordable Housing Fund grant as set out in the report be allocated to the project to secure 40 subsidised care beds in the proposed development of 111 Shirland Road.

4.            That the Cabinet Member for Housing, Regeneration, Business and Economic Development authorised the Executive Director Growth, Planning and Housing, the Director of Housing and Regeneration and the Director of Property, Investment and Estates to appropriate for planning purposes the Council’s interest in the land shown outlined in red on the plan at Appendix C, under section 122 of the Local Government Act 1972 and to subsequently exercise the powers under  section 203 of the Housing and Planning Act 2016, subject to obtaining the necessary Secretary of State consents and subject to being satisfied that all the necessary conditions being met for the exercise of these powers.

5.            That the Cabinet Member for Housing, Regeneration, Business and Economic Development agreed to the transfer of land between the Housing Revenue Account and the General Fund as outlined in the plan at Appendix D, up to a value as set out in the report, subsequent to obtaining a red book valuation on the land, prior to the appropriation for planning purposes and the consents outlined in 3.4 above.

6.            That the Cabinet Member for Housing, Regeneration, Business and Economic Development authorised the Director of Housing, the Director of Property, Investment and Estates and the Tri-Borough Director of Law,to deal with all necessary legal arrangements to effect the appropriation and use of section 203 powers as set out in this report including where deemed necessary to seek consent from the Secretary of State relating to the proposed appropriation.

Reason for the Decision

The Council is satisfied that the redevelopment will contribute towards meeting the City for All objectives, specifically contributing to the Adult Services and Housing Strategies, with the achievement and improvement of the economic, social and environmental well-being of the local area.
