2.1       The Chairman explained that a week before the meeting, all four Members of the Committee were provided with a full set of papers including a detailed officer’s report on each application; together with bundles of every single letter or e-mail received in respect of every application, including all letters and emails containing objections or giving support. Members of the Committee read through everything in detail prior to the meeting. Accordingly, if an issue or comment made by a correspondent was not specifically mentioned at this meeting in the officers’ presentation or by Members of the Committee, it did not mean that the issue had been ignored. Members will have read about the issue and comments made by correspondents in the papers read prior to the meeting.

 

2.2       Councillor Spencer declared that he sat on the original Planning Committee for item 4.

 

2.3       Councillor Glen declared that the Applicant for item 3 was a personal friend, however they had not discussed the application.

1.         Grant conditional permission, subject to:

 

a) Additional Condition 15 wording:

 

You must apply to us for approval of detailed drawings showing the following alteration(s) to the scheme:

 

-           the rear windows to the mansard re-designed with an architectural device to prevent direct overlooking.

 

You must not start on these parts of the work until we have approved what you have sent us. You must then carry out the work according to the approved drawings.

 

b) No building works or construction will take place on a Saturday

c) The completion of a S106 legal agreement to secure the following planning obligations:

 

i.          Notice of commencement of development;

ii.         A financial contribution of £440,000 to the Affordable Housing Fund to allow provision of affordable housing elsewhere in the City (payable on commencement of development and index linked);

iii. A financial contribution of £33,003 to the Carbon Off-Setting Fund (index linked); and

iv. Costs of monitoring the S106 agreement.

 

2. If the S106 legal agreement to secure the planning obligations has not been completed within 6 weeks of the Sub-Committee date then:

 

a)         The Director of Place Shaping and Town Planning shall consider whether it would be possible and appropriate to issue the permission with additional conditions attached to secure the benefits listed above. If so, the Director of Place Shaping and Town Planning is authorised to determine and issue such a decision under Delegated Powers; however, if not;

 

b)         The Director of Place Shaping and Town Planning shall consider whether permission should be refused on the grounds that the proposals are unacceptable in the absence of the benefits which would have been secured; if so, the Director of Place Shaping and Town Planning is authorised to determine the application and agree appropriate reasons for refusal under Delegated Powers.

The presenting officer tabled the following amendment to the draft decision letter, a new informative and clarifications in the officer report:

 

1.         Revised wording of reason for refusal of planning application: -

 

The proposal would result in the conversion of the buildings into too few units which would fail to optimise the use of the site for residential purposes, especially when compared to space standards set out in the Technical housing standards - nationally described space standard March 2015 and would harm the delivery of housing numbers in the Borough.  This is contrary to policy S14 of our City Plan that we adopted in November 2016 and paragraph 122 of the National Planning Policy Framework.  

 

2.         New informative to planning application-

 

The proposal to provide for 44 affordable units at Chesterfield Lodge, St John’s Wood, as the off-site affordable housing contribution, does not outweigh the failure of the proposal to optimise the site for residential purposes.

 

3.         Clarifications within report:

           Paragraph 6.2- 21 units should be 28 units

           Paragraph 8.2, second paragraph line 5- 16 (2) should be 66 (2)

 

 

RESOLVED UNANIMOUSLY:

 

1. Refuse permission – failure to optimise the residential use of the site.

2. Grant conditional listed building consent.

3. Agree reasons for granting conditional listed building consent for the reasons set out in Informative 1 of the draft decision letter.
