Mr
Jackaman introduced the item advising that the Sub-Committee had
before it an application for a new premises licence from Zayouna
Ltd (the Applicant). He advised that
the application had received representations from the Environmental
Health Service, 33 local residents, the Lilestone Residents and
Management Organisation and the Met police. It was noted that the Met Police representation
was withdrawn on 26 February 2020 after the agreement to additional
conditions. Mr Jackaman indicated that
further submissions had been made by Environmental Health on 6
March 2020 and that the submissions were reviewed and circulated to
all relevant parties.
The
Sub-Committee heard the Applicant’s Case
Mr
Ismail addressed the Sub-Committee advising that his premises was a
restaurant and it intended to operate as a restaurant which also
provided the option of Shisha. He
informed the Sub-Committee that in June 2019 he applied for a
licence and was granted a time limited licence between 9 April 2019
and 9 February 2020. Mr Ismail informed the Sub-Committee that he
had made a mistake on the application and was now applying for a
full premises licence. He advised that
he was now applying for indoor Late-Night Refreshments, between the
hours of 23:00 to 00:30 on Sunday to Thursday and 23:00 to 01:30 on
Friday to Saturday. He explained that
he would be selling alcohol free drinks and hot food.
Comments from the Licensing Sub-Committee:
The Sub-Committee asked Mr Ismail to describe the
garden building and basement plans for the premises, and also
queried the licensable area for the application. Mr Ismail
confirmed that the application and licensable area was for the
entire building and the external area to the rear. The Sub-Committee confirmed with Mr Ismail that
conditions 14-28 had been agreed with the police and conditions
11-13 agreed with Environmental Health services. The Sub-Committee also sought further clarity
regarding how smoking will be managed at the premises and how
conditions 12 and 13 will work and whether smoking would be allowed
at the front of the premises. Whist
viewing photographs of the premises, the Sub-Committee noted the
large screens in the celling, confirming with Mr Ismail that no
noise should be emanating from the premises.

Mr
Jackaman introduced the item advising that the Sub-Committee had
before it an application for a new premises licence from Mr Jack
Albini (the Applicant). He advised that
the application had received representations from the Environmental
Health Service, one Local Councillor (speaking on behalf of all
three Councillors for the Little Venice Ward), 3 local residents,
the Paddington Waterway and Maida Vale Society and the Metropolitan
Police. It was noted that the Police
representation was withdrawn on 5 February 2020 after the agreement
to additional conditions. Mr Jackaman
indicated that a further submission had been forwarded by Mr
Richard Brown (CAB Project Officer), on behalf of the Paddington
Waterway and Maida Vale Society on 6 March 2020 and that the
submission had been reviewed and circulated to all relevant
parties.
The
Sub-Committee heard the Applicant’s Case
Mr
Panchal addressed the Sub-Committee advising that the premises had
previously operated as a florist and was considered to be an A1
premises under planning terms. He
confirmed that there would be no cooking onsite and food would be
prepared from services outside of the premises, reheated and served
to customers. Mr Panchal advised that ideally his client would like
to be able to serve Champagne breakfasts at 08.00 and he confirmed
that there would be no music. He further indicated that his client
will be applying for A3 planning use in due course. Mr Panchal also advised the Sub-Committee that his
client would reduce the hours for the
sale of alcohol to 20:00.
Mr
Panchal advised the Sub-Committee that there would be training for
all members of staff and that there is a substantial food offer,
referring to the menu. He confirmed
that the Police had withdrawn their objection and that his client

Decision:
Mr
Jackaman introduced the item advising that the Sub-Committee had
before it an application for a premises variation from the Swedish
Church In London Ltd (the Applicant).
He advised that the application had received representations from
the Environmental Health Service, 3 local residents and the
Metropolitan Police. It was noted that
the Police representation was withdrawn on 30 January 2020 after
the agreement to additional conditions.
The
Sub-Committee heard the Applicant’s Case
Ms
Sarah Skansing addressed the Sub-Committee advising that the
Swedish Church had been present in the UK for over 300 years and
this premises had been established in 1910. She advised that the
premises were open 7 days per week and already benefited from a
premises licence. Ms Skansing advised
the Sub-Committee that the premises occasionally held evening
events; however, the Church wanted the freedom to take bookings and
not have to apply for a Temporary Event Notice each
time. Ms Skansing informed the
Sub-Committee that the Church held knitting groups, concerts and
other community events at the premises.
Ms
Skansing advised the Sub-Committee that the Church is generally
closed by 21:00. However, there have been some requests for event
to finish later than 21:00 and they want some
flexibility. She advised there was no
intention to ramp up the number of events but wanted to be able to
host some small parties indoors. She
advised that there were no windows in the centre of the building
and there were 6 members of staff who live on the premises, so
there would be no late-night events. Ms
Skansing informed the Sub-Committee that the Church is closed for 5
weeks during the summer and no outdoor areas of the building would
be used for events. She also advised
the Sub-Committee that no complaints had ever been made
previously.
The
Sub-Committee heard from Environmental Health Services:
Mr Koduah addressed the Sub-Committee and confirmed
that the Environmental Health Service had maintained their
objections on the grounds that the supply of alcohol and the hours
requested would have the likely effect of causing an increase in
Public Nuisance and may affect Public Safety within the area.
